Gwalior High Court Remands OBC Certificate Case of District Judge's Daughter

The Gwalior High Court has remanded the OBC certificate case of Ragini Rathore, daughter of a district judge, to the SDM Isagarh in Ashoknagar district for fresh consideration. The court set aside earlier orders by the Ashoknagar collector and SDM that had rejected her application based on her father's annual income of Rs 16,99,282.
The High Court observed that creamy layer determination cannot rely solely on salary figures. It directed the competent authority to examine the father's employment status, date of promotion, and source of income alongside applicable government circulars and Supreme Court judgments. The authority has been instructed to provide a hearing to the petitioner and deliver a reasoned order within six weeks, strictly in accordance with law.
