Jharkhand High Court Partly Allows Appeal Against UAPA Property Attachment

The Jharkhand High Court Division Bench partly allowed an appeal challenging property attachment under the Unlawful Activities (Prevention) Act, 1967. The court released a TVS scooty owned by one appellant, citing her independent employment and salary as proof of legitimate acquisition. However, it upheld attachment of a JCB loader and double-storeyed building, finding appellants failed to produce adequate documentary evidence establishing legal sources of funds.
The case stemmed from a January 2016 police raid following intelligence about alleged levy collection by members of the banned Tritiya Prastuti Committee in Chatra district's coal belt. Police recovered ₹91.75 lakh in cash and firearms from one accused, who could not adequately explain the money's origin. Two others were also arrested at the location.
The bench distinguished between properties based on evidentiary strength, emphasizing that attachment orders require clear proof linking assets to alleged terror funding.
