Spouse cannot be held liable for public official's dues, says Rajasthan High Court

The Rajasthan High Court has ruled that a spouse cannot be compelled to clear dues owed by their partner who served as a public official, as a condition for contesting elections. Justice Anoop Kumar Dhand held that a husband could not be required to settle dues recoverable from his wife, a former Sarpanch, to obtain a No-Dues Certificate for Gram Panchayat elections.
The Court observed that the petitioner was neither a surety nor guarantor for his wife's dues. It noted that neither the Rajasthan Panchayati Raj Act, 1994 nor the Rules, 1996 authorized recovery of such dues from family members of a Sarpanch. The wife had served during 1995–2000, and dues were ordered against her following an inquiry into panchayat works.
The judgment reaffirms that husband and wife are separate legal entities under law, establishing that electoral participation cannot be restricted based on a spouse's outstanding financial liabilities to the state.
