Calcutta High Court orders ₹47 lakh recovery in money lending dispute

Calcutta High Court's Single Judge Bench of Justice Sugato Majumdar has decreed recovery of ₹47 lakh in a money lending case. The court found the plaintiff entitled to the full amount with 10 per cent annual interest from the date of suit filing until repayment, rejecting the defendant's defences.
The defendant, proprietor of Transmart Container Lines, admitted to lending money in his written statement but failed to provide evidence supporting his claims of repayment and coercion. The court relied on the plaintiff's oral and documentary evidence to establish the monetary claim.
The dispute originated when the plaintiff's consignment was allegedly withheld despite full payment. The plaintiff, a PET resin manufacturer, had engaged the defendant as a carrier for three PTA consignments from Korea to Haldia Port in 2012, valued at approximately ₹7.42 crore.
