Courts reject indefinite trial delays as bail ground in UAPA cases

High courts are increasingly rejecting the argument that trial delays alone justify continued detention in UAPA cases, signalling a shift in bail jurisprudence. Cases involving activists Sharjeel Imam, Umar Khalid, Khurram Parvez and Irfan Mehraj have highlighted how prolonged undertrial incarceration raises questions about the limits of judicial patience with delayed proceedings.
Courts are now examining whether indefinite postponement of trials can become independent grounds for bail, moving beyond the standard position that mere delay is inherent to complex cases. This trend reflects growing judicial concern over the practice of extended pretrial detention in terrorism-related cases.
