The Delhi High Court has clarified that pre-arrest protection granted in a predicate offence does not automatically extend to proceedings under the Prevention of Money Laundering Act (PMLA).
Justice Madhu Jain stated that "the petitioner cannot claim pre-arrest protection in the present proceedings merely on the ground that such protection has been granted to him in the predicate offence."
The judgment distinguishes between protections available under different legal frameworks, establishing that PMLA cases must be evaluated independently based on their own merits and circumstances.
