GHAC Arbitration Week 2026: Six Jurisdictions Discuss Law Governing Arbitration Agreements

A panel discussion at GHAC Arbitration Week 2026, titled "Rules of Private International Law Governing International Commercial Arbitration," brought together senior legal experts from multiple jurisdictions. The session was moderated by Anirudh Krishnan, a barrister and Indian counsel.
Former Singapore judge Vijaya Kumar Rajah, who previously served as Attorney General and is Vice President of the ICC International Court of Arbitration, emphasised the importance of finality in arbitration agreements. He noted that parties contracting to arbitrate accept that tribunal decisions are binding, even if legally incorrect, though parties may occasionally act in bad faith.
Rajah highlighted India's challenge in developing specialist expertise in international arbitration, saying India lacks neither people nor talent but requires sustained capacity-building and training. He suggested establishing a credible Indian Chartered Institute of Arbitrators rather than relying on foreign institutes.
