High Court Rules Owning Other Flats Does Not Bar Eviction of Tenants

A Delhi High Court ruling has clarified that a landlord's ownership of other residential or commercial properties in the same vicinity does not prevent them from initiating eviction proceedings against a tenant.
The court held that factors such as owning, selling, or renting other premises cannot debar a landlord from seeking eviction if they can demonstrate bona fide requirement without malice. Similarly, the mere existence of alternative vacant accommodation is not grounds to deny eviction.
When a landlord seeks premises for commercial purposes, courts must consider external factors including location, floor level, locality, visibility, and access, alongside internal factors such as financial capability and sustainability of the proposed use.
