Suicide note absolving accused weakens abetment case; Himachal HC grants bail to husband

The Himachal Pradesh High Court granted regular bail to a husband accused of abetment of suicide under Section 108 of the Bharatiya Nyaya Sanhita, 2023. A single-judge bench observed that a suicide note found at the scene—in which the deceased stated she was committing suicide of her own volition and that no person should be harassed—weakens the prosecution's prima facie case.
The court noted that the suicide note carried greater evidentiary weight than diary entries from 2014 and letters dated September 2025, in which the deceased had alleged matrimonial harassment. The case originated from the death of a married woman found hanging on 2 June 2026 at her residence. Police alleged the husband and his mother subjected her to harassment, including restricting her movements and withholding maintenance payments.
The bail was granted subject to stringent conditions.
