Legal Requirements for Political Party Mergers Explained by Supreme Court Senior Advocate

Senior Advocate Mahesh Jethmalani has outlined the constitutional framework governing political party mergers. According to Paragraph 4 of the Tenth Schedule of the Constitution, a merger is valid only when at least two-thirds of the members of a Legislature Party agree to combine with another political party.
Jethmalani, a former Additional Solicitor General, emphasized that the law on such mergers is explicit, establishing a clear threshold for legitimacy in faction combinations and party reorganizations.
