Supreme Court Says Re-arrest of Accused Requires Magistrate Approval After Illegal Detention

The Supreme Court has ruled that if an investigating agency wishes to re-arrest an accused after a detention is found to be illegal under Article 22 of the Constitution, it must obtain fresh magistrate approval.
The court held that if the investigating agency continues to require the accused's custody following such a constitutional violation, it must satisfy all constitutional safeguards before proceeding with a fresh arrest.
This ruling reinforces protections against unlawful detention and ensures that procedural checks remain in place even after an initial detention is struck down as unconstitutional.
