Auction Purchaser Must Clear Previous Owner's Dues Before Society Membership: Bombay HC

The Bombay High Court has held that a purchaser acquiring a flat through bank auction cannot claim membership of a cooperative housing society without first settling the previous owner's unpaid maintenance dues.
The court ruled that where the sale certificate and the Maharashtra Co-operative Societies Act stipulate payment as a condition for transfer of membership, auction purchasers must comply with this requirement before obtaining society membership rights.
The judgment clarifies obligations for auction purchasers, housing societies, and homebuyers navigating property transfers through auction proceedings.
