Delhi High Court Grants Interim Relief to Emami Agrotech Against FSSAI Notice

The Delhi High Court on 15 October 2026 granted interim relief to Emami Agrotech Limited, restraining the Food Safety and Standards Authority of India (FSSAI) from taking further action on a Show Cause Notice dated 5 June 2026. Justice Amit Mahajan directed FSSAI to not proceed pending the next hearing date.
The FSSAI had alleged that Emami's brand name "Emami Healthy & Tasty" for its edible oil range—including sunflower oil and kachchi ghani mustard oil—was misleading and violated the Food Safety and Standards Act, 2006 and related regulations. On 17 July 2026, FSSAI had issued a letter directing food safety commissioners across the country to initiate enforcement action and halt manufacture, distribution, marketing and sale of the company's products.
Emami challenged the FSSAI actions, contending they were not lawful. The company was represented by Senior Advocate Sandeep Sethi and a team from law firm Shardul Amarchand Mangaldas & Co. This marks a second interim relief for Emami against FSSAI, following a similar court intervention by the Calcutta High Court.
