Bail can be denied even after prolonged custody in drug cases, says Madras HC

The Madras High Court has clarified that prolonged judicial custody alone cannot override the stringent bail provisions under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. Justice N. Ramesh stated that the lengthy period of incarceration will not supersede the restrictions imposed under Section 37 of the NDPS Act.
The ruling underscores the legislature's intent to maintain strict bail conditions in narcotic drug offences, even when an accused has spent considerable time in custody awaiting trial.
