Supreme Court Issues Notice on Bihar Minister Deepak Prakash's Reappointment

The Supreme Court has issued notices to the Bihar government, Election Commission, and Panchayati Raj Minister Deepak Prakash regarding his reappointment as minister. A bench headed by Chief Justice SUryakant and Justice V. Mohan heard a petition by activist Rakesh Kumar Singh challenging the constitutional validity of Prakash's ministerial position.
The petition contends that Prakash is not a member of the state assembly or council. Under Article 164(4) of the Constitution, a person can serve as minister for a maximum of six months without being an elected representative—but only once. The petitioner argues this exemption cannot be availed again following resignation, cabinet reshuffle, or government change. Prakash was appointed minister on November 20, 2025, without holding legislative membership.
