Woman cannot seek maintenance hike after husband's death: Bombay High Court
The Bombay High Court has ruled that a divorced wife cannot seek an increase in maintenance after her husband's death. However, she retains the right to claim any maintenance amounts already decreed and arrears owed from his estate.
The court clarified that while the right to maintenance is personal and extends for a lifetime, any request for enhancement of maintenance requires both parties to be alive. The ruling distinguishes between claiming existing maintenance obligations and seeking new modifications.
