Bombay HC Issues Notice To MBMC Over Alleged Disobedience Of Court Order In Windsor Project

The Bombay High Court has issued notice to the Mira Bhayandar Municipal Corporation (MBMC) and its commissioner for allegedly violating an interim order protecting a developer from adverse action. A bench led by Acting Chief Justice Ravindra Ghuge expressed strong displeasure, questioning why the civic body followed an MLA's directions despite a Division Bench order.
The court was hearing a contempt petition filed by M/s Grandbuild Land Developers LLP. The developer alleged that despite a court order from April 27, MBMC issued a communication directing construction be stopped or permission would be cancelled. Subsequently, MahaRERA placed the project in abeyance, froze the developer's accounts and barred execution of sale deeds.
MBMC Commissioner Radhabinod Aribam Sharma appeared via video conference and offered to withdraw the orders and apologize. However, the court refused to accept the apology, stating it was a "gross case" and declined to close contempt proceedings.
