Bombay High Court Bars BMC From Permitting Unauthorised Events at Cuffe Parade Garden

The Bombay High Court has directed the Brihanmumbai Municipal Corporation (BMC) to prevent unauthorised commercial functions and high-decibel events at the Cuffe Parade Greens Garden on Captain Prakash Pethe Marg. A division bench comprising Chief Justice Mahesh Chandra Tripathi and Justice Advait M Sethna disposed of a writ petition filed by the Cuffe Parade Welfare Association through its president Dr Padmakar Nandekar on October 16, 2026.
The residents sought court intervention to restrain unauthorised commercial activities, private events, and noise-generating activities including loudspeakers, DJ systems and dhols at the 12,000-square-metre plot. The petition was filed after part of the garden was converted into a venue for Navratri celebrations without proper clearance.
The court held that the BMC and competent authorities must ensure all activities on the plot conform to civic norms and municipal circulars prohibiting commercial programmes and marriage ceremonies on reserved public grounds. The High Court observed that events contrary to these guidelines should not be permitted, directing the BMC to ensure due compliance with its circulars.
